Privacy Policy

The purpose of this policy is to set out how Top Shelf Recruitment Pty Ltd (Top Shelf Recruitment) collects, holds, uses, discloses and otherwise deals with personal information under the Privacy Act 1988 (Cth) (Act).

Top Shelf Recruitment is committed to protecting the privacy of all personal information (as defined by this Privacy Policy) stored by Top Shelf Recruitment. The Act governs the way we collect, use, disclose, and store personal information. This Privacy Policy describes how we aim to adhere to those principles contained within the Act.

Personal Information

For the purposes of this Privacy Policy, personal information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and
whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion. Examples of personal information which may be collected and stored may include:

1.      Names, addresses, email addresses and telephone numbers;

2.      Passport and visa details;

3.      Bank and superannuation details;

4.      Details regarding gender and nationality;

5.      Emergency contact details;

6.      Dates of birth and contact details;

8.      Driver’s licence;

9.      Qualifications, employment records and information from CVs, resumes or job application forms; or

10.  Tax file numbers.

Privacy Principles

Subject to the other provisions of this Privacy Policy, Top Shelf Recruitment adheres to the following general privacy principles:

1.      We only collect personal information by fair, lawful and non-intrusive means.

2.      We only use or disclose information for the purpose for which it was collected.

3.      We take reasonable steps to ensure the personal information we collect, use or disclose is accurate and up-to-date.

4.      We have procedures in place to protect the personal information we hold from misuse, loss or unauthorised access.

5.      We clearly set out our management of personal information in this Privacy Policy, which we make available to anyone who asks for it.

6.      We provide individual access to personal information held about the individual, and if we cannot provide access we will give reasonable written reasons for declining the request.

7.      We will use Commonwealth Government identifiers for the purpose for which they were issued, and we will not adopt our own identifiers of an individual except where it is necessary to carry out our functions effectively.

8.      Wherever lawful and practical, you will have the option of remaining anonymous when entering into a transaction with us. 

9.      We will only transfer personal information to a recipient in a foreign jurisdiction in circumstances where the information will have an appropriate level of protection.

Top Shelf Recruitment does not collect sensitive information, such as information on the health or criminal record of an individual, unless the individual has consented or it is required by law, or in special circumstances relating to the health and safety of an individual or the public in general.

Collection of Personal Information

Top Shelf Recruitment may collect personal information in various ways, including by way of dealing with you in person, over the telephone, through our website (including when you complete an application on our website, register as a user of our site or submit an enquiry through our website) or in writing. We may also collect personal information relating to third parties.

Use of Personal Information

Top Shelf Recruitment usually collects personal information so that we can assess and employ an applicant for a current or future role. The information we collect about applicants is used for reasons directly related to Top Shelf Recruitment's business and to allow us to perform the services applicants expect from us (including to facilitate and/or determine applications for employment or engagement with us or our clients). We may also use Personal Information of applicants to provide applicants with information and updates (including in relation to the job market or job opportunities), to undertake statistical analysis, or to evaluate the effectiveness of the services we provide. 

Disclosure of Personal Information

Top Shelf Recruitment discloses Personal Information regarding applicants to our clients or potential clients, who labour hire or engage those applicants. We may also disclose an applicant’s Personal Information to a third party for the purposes of checking a reference provided in the applicant’s job application. We may also disclose the Personal Information of applicants to contracted parties whom we engage to perform services on our behalf (including contractors, web hosting providers,
IT systems administrators, couriers, payment processors, data entry service providers, professional advisors such as accountants, solicitors, business advisers and consultants, marketing or PR agencies and other third parties we may engage to assist in the operation and maintenance of our business and Website).  These persons will only have access to such Personal Information required by them to perform their functions and may not use such Personal Information for any other purpose. 

We may also disclose the Personal Information of applicants after their engagement has commenced with Top Shelf Recruitment, to clients who labour hire those applicants, for the purpose of those clients conducting an audit to ensure compliance with
workplace and immigration laws.

Top Shelf Recruitment may also disclose your personal information if:

1.      You consent to the disclosure;

2.      You would reasonably expect Top Shelf Recruitment to disclose the information for a purpose other than the purpose for which it was obtained (Secondary Purpose) and the Secondary Purpose is:

i.      If the information is sensitive information – directly related to the primary purpose for which it was originally obtained; or

ii.      If the information is not sensitive information – related to the primary purpose for which it was originally obtained;

iii.      The disclosure of the information is required or authorised by or under an Australian law or a court/tribunal order;

iv.      A permitted general situation exists (as that term is defined by the Act) in relation to the disclosure of the information; or

v.      We reasonably believe that the use or disclosure of the information is reasonably necessary for one or more enforcement related activities conducted by, or on behalf of, an enforcement body. If any personal information is disclosed in accordance with this clause, Top Shelf Recruitment will notify you in writing of the disclosure.

Storage, security and destruction of tax file number information

Top Shelf Recruitment will take reasonable steps to:

1.      Protect tax file number information from misuse, loss and from unauthorised access, use, modification or disclosure; and

2.      Ensure that access to records containing a tax file number is restricted to those who need to handle that information.

Cookies and Statistical Analysis

Top Shelf Recruitment’s website uses cookies. When a person visits our website or completes an application form, certain information may be recorded for statistical purposes, including information regarding the following:

1.      Server address;

2.      Domain name;

3.      Date and time of visit;

4.      Previous websites visited; and

5.      Browser type.

Site and Information Security

Although Top Shelf Recruitment has implemented substantial security measures in relation to personal information, we cannot provide any guarantee regarding security of the personal information and other data transmitted to us.

Top Shelf Recruitment will not be liable in any way in relation to any breach of security or unintended loss or disclosure of personal information or other data due to the website being linked to the internet. Furthermore, although Top Shelf Recruitment will not give any of your personal information to a third party without your permission except in circumstances permitted or required under the Act, we will not be liable in any way for the actions of third party sites from which you may have linked and been directed to from our website. When we no longer need your personal information in order to provide the services we will destroy or delete it in a secure manner.

Our website may contain links to and from the websites of third parties (Third Party Sites). If you follow a link to any of these Third Party Sites, please note that they have their own privacy policies and that we do not accept any responsibility or liability for the use of any personal information or other data by third parties.

Transfers of personal information outside Australia

The personal information that Top Shelf Recruitment will collect from you may be transferred to, and stored at, a destination outside Australia for the purpose of providing the services and for other purposes set out in this Privacy Policy.

Access to and correction of your personal information

If you wish to verify or correct any of the details you have submitted to us, you may do so by contacting our office. Our security procedures mean that we may request proof of identity before we reveal personal information. This proof of identity will take the form of your e-mail address and password submitted upon registration. You must therefore keep this information safe as you will be
responsible for any action which we take in response to a request from someone using your e-mail and password. You have the right to access the information which we hold about you (subject to the privacy of others) and can also ask for corrections to be made to this information.
